HARASSMENT POLICY
Harassment because of race, color, sex, religion, ancestry or national origin, age or disability is prohibited. Such conduct is a violation of Board Policy and may constitute illegal discrimination under state and federal laws.
Harassment includes but is not limited to verbal abuse, threats, or physical assault based on race, color, sex, religion, ancestry or national origin, age or disability. Under the Maine Civil Rights Act, violence or threats of violence against a person or their property based on their sexual orientation are also illegal.
Unwelcome sexual advances, suggestive or lewd remarks, requests for sexual favors, and other verbal and physical conduct of a sexual nature constitute sexual harassment when:
1. Submission to or rejection of such conduct is made either explicitly or implicitly a term or condition of employment.
2. Submission to or rejection of such conduct is used as a basis for employment decisions affecting the individual who submits or rejects.
3. Such conduct has the purpose or effect of interfering with an employees work performance or creates an intimidating, hostile or defensive working environment.
Incidents of harassment should be reported to the Superintendent, an immediate supervisor or the affirmative action coordinator immediately. Reported incidents will be investigated promptly.
It is expressly against District policy for any employee to make any sexual advancements or request for sexual favors to a student, or to engage in any other physical or verbal conduct of a sexual nature with a student. In addition, it is against District policy for the above to occur student to employee and student to student.
Any employee who engages in harassment or sexual harassment will be subject to disciplinary action up to and including discharge.
Incidents, inquiries or concerns regarding sexual harassment should be forwarded immediately to The Affirmative Action Coordinator for M.S.A.D. No. 71, 87 Fletcher Street, Kennebunk, ME 04043, 985-1100.
